Proof of interest

Recipients of paid business information confirm that they have the legally required proof of interest for viewing the data in accordance with Art. 13 Para. 2 c of the FADP. At the same time, they confirm that the data will only be used for permissible purposes (taking into account, among other things, the restrictions in the employment relationship pursuant to Art. 328b CO). Furthermore, they confirm that they can make this proof of interest available to the competent control bodies at any time.

Terms of Use

Users undertake to utilize the services provided by Dun & Bradstreet on the Monetas platform for their intended purpose and to refrain from any improper or illegal use, e.g., the introduction of malicious software (such as viruses, worms or other spyware). In addition, the services may not be used in a way that negatively affects the availability for Monetas, other users or otherwise (e.g., through the use of automatic devices, scripts and robot, spider, crawler or scraper services).

Users shall only utilize the services provided to them in accordance with the applicable laws. In particular, they shall ensure compliance with the provisions of the Data Protection Act, the Unfair Competition Act and the Copyright Act and shall indemnify Dun & Bradstreet against any claims made by third parties against Dun & Bradstreet for breach of the aforementioned provisions.

Intellectual property

Users acknowledge that the services, the third-party services and the content published on the services by Dun & Bradstreet, third parties or other users are generally protected by law and that any use thereof requires the consent of the respective rights holder.

Reproduction, transmission (by electronic or other means) or modification of the services or content, in whole or in part, is not permitted.

Copying, downloading or printing of the services or contents is only permitted for personal, non-commercial use, provided that neither any copyright notices nor other legally protected designations are removed.

The complete, partial or excerpted use of the data made available via the services for commercial address utilization, business information, commercial provision of information or as a basis or aid for the compilation or supplementation of subscriber, address or other directories in any form (electronically, in print form, on data carriers, etc.) as well as the reading of the data on the internet for the aforementioned purposes and for purposes of other commercial use are prohibited.

The names "Monetas", "monetas.ch" and "bisnode.ch" and certain other product or service names, including logos, are registered trademarks of Dun & Bradstreet.
D-U-N-S® numbers are the property of Dun & Bradstreet, Inc. and users have no right to use these trademarks. The same applies to the trademarks of third parties, in particular third-party services.

Conditions of Use for the Rating of Companies

1. Scope

These Conditions of Use govern the use of the rating services of Swiss companies provided by Dun & Bradstreet Schweiz AG (hereinafter referred to as Dun & Bradstreet) on monetas.ch. Minors can only rate companies on monetas.ch with the consent of their legal guardians, whereby the legal guardians are liable for violations of the Terms of Use.

Dun & Bradstreet reserves the right to change these Terms of Use for the rating of companies at any time. If adjustments are made, Dun & Bradstreet will publish them immediately on monetas.ch. It is the users' responsibility to inform themselves about the current version of the Terms of Use.

2. Rules of conduct

Defamatory contributions or those with racist, discriminatory, sexist, pornographic or violence-glorifying content are prohibited.

Furthermore, no content may be published that is threatening, abusive, harassing, defamatory, vulgar, hateful, otherwise harmful or of an advertising nature. Dun & Bradstreet reserves the right not to publish contributions that violate the rules or to remove them completely and without further notification. Misuse will be prosecuted.

Reviews that have no relation to the rated company as well as reviews that were obviously written under fictitious names or with a false author will also not be published.

3. Responsibilities of the user

Users are responsible for all content they create.

Users are aware that the information they disclose may be published and, accordingly, is not private in nature. Dun & Bradstreet therefore advises users not to disclose personal data in the rating text.

In particular, users undertake not to publish any content that violates the applicable Swiss law and/or infringes the rights of third parties (including their personal rights).

In addition, users refrain from offering and linking to the following content:

Content that is considered obscene, offensive, defamatory, indecent, pornographic, harassing, racist, xenophobic or otherwise objectionable according to general moral standards and, in the final instance, according to Dun & Bradstreet's decision;

Content that acts as advertising for third parties.

In this regard, users indemnify Dun & Bradstreet against all recourse, litigation, damages and other actions and claims that may be brought or asserted by third parties in any capacity following the submission of their ratings.

4. Transfer of rights

Users explicitly allow other website visitors to view their recorded company ratings. Users grant Dun & Bradstreet non-exclusive rights, unlimited in time, area and subject matter, to use the submitted company ratings.

Dun & Bradstreet may also use the company ratings in other products and services outside monetas.ch. The company ratings can also be embedded as a link on third-party websites or made available for viewing on third-party websites (e.g., Facebook, Google+, etc.) by means of an upload.

Published user content may be found on search engines; Dun & Bradstreet has no control over the deletion of content from search engines.

5. Liability limitations

The content expressed by users does not represent the opinion of Dun & Bradstreet. Accordingly, Dun & Bradstreet accepts no responsibility for any content communicated by users. Dun & Bradstreet shall not be liable for any loss of data and/or other damages incurred by users or third parties as a result of the use of the service. Dun & Bradstreet shall not be liable for the functionality and compatibility of the user’s hardware. Users are solely responsible for the hardware they use.

6. Personal data of the users/registration

The users have to register in order to be able to submit company ratings on monetas.ch. They are obliged to keep their login data (password etc.) secret and not to make them accessible to third parties. Users are responsible for all actions taken using their login information.

The users assure that the personal data entered are true and complete. Users also agree that their data will be registered with Dun & Bradstreet and stored electronically.

Incomplete registration and untrue information will result in the rejection of users. Users are obliged to keep their personal data up to date. Dun & Bradstreet must be notified immediately of any changes in address details (move, new email address etc.). Dun & Bradstreet reserves the right to delete any incorrect information.

Dun & Bradstreet complies with applicable legislation when handling user data.

7. Data backup

Dun & Bradstreet does not guarantee the backup or archiving of recorded company ratings.

8. Indemnification

All users agree to indemnify and hold Dun & Bradstreet harmless from and against any and all liabilities, expenses and claims arising from damages due to defamation, libel, infringement of privacy rights, failure to provide services to users, infringement of intangible property or other rights. The costs incurred by the service or its employees and/or third parties in this respect for a reasonable legal defense and prosecution against the third parties shall be borne by the users.

Purchase on account

In the case of purchase on account, the invoiced amount must be paid to the account of our external partner, Billpay GmbH as detailed on the invoice by the due date stated on the invoice form at the latest. The payment method purchase on account does not exist for all offers and requires, among other things, a successful credit check by Billpay GmbH. If the customer is allowed to purchase on account for certain offers after a credit check, the payment is processed in cooperation with Billpay GmbH, which takes over the merchant's invoice claim after the conclusion of the purchase contract. We remain responsible for general customer inquiries (e.g., about the goods, delivery time, dispatch), returns, complaints, revocation declarations and deliveries or credit notes, even if you purchase on account via Billpay.

 If you do not meet your payment obligation, you will be in default upon expiry of the payment deadline set for you without any further reminder and will have to pay default interest of 8%. Billpay shall be entitled to charge a reminder fee of up to CHF 30 per payment reminder as well as other fees, in particular the costs of any debt collection proceedings. Furthermore, Billpay may in future refuse to process the payment terms of sales contracts, including those relating to other merchants. The General Terms and Conditions of Billpay GmbH apply.

In the case of consumers, we retain ownership of the purchased item until the invoice amount has been paid in full. If you are an entrepreneur exercising your commercial or self-employed professional activity, a legal entity under public law or a special fund under public law, we reserve ownership of the purchased item until all outstanding claims from the business relationship with the customer have been settled. The corresponding security interests are transferable to third parties.

You shall only be entitled to set-off, if your counterclaims have been legally established or are undisputed or acknowledged by us. Furthermore, you only have a right of retention if and insofar as your counterclaim is based on the same contractual relationship.

If the customer is in default with any payment obligations towards us, all existing claims shall become due immediately.

Liability / content

The content of these websites is maintained with greatest possible care. Nevertheless, no liability is assumed for the content. Misprints, errors and changes reserved. The content is protected by copyright.

We assume no liability for the content of external links. The operators of the linked websites are solely responsible for their content.

Non-compliance with the Terms and Conditions of Use

In case of non-compliance with these Terms and Conditions of Use, Dun & Bradstreet shall have the right to suspend or deny a user access to the services and to take further legal action, if required.
